GENERAL CONDITIONS

1. Equipment

The Rental refers exclusively to the equipment or accessories defined in the Rental proposal;

2. Location, Regime and Conditions of Use

The Equipment is intended for use at the location indicated in the Rental proposal. Changing the place of use requires communication to the Lessor.

The lessee undertakes to use and maintain the equipment correctly and appropriately.

3. Duration

The rental period starts from the day the material is made available to the Lessee and until the day the request for collection of the equipment or its delivery to the Lessor's premises is communicated.

The effective use of the equipment is based on the number of calendar days. If any defect is found in the functioning of the equipment, the Tenant must inform the Lessor, who will replace it within a maximum of 24 hours.

At the end of the rental period, the equipment is returned upon arrival at the Lessor's premises, and must be in good working order.

4. Rates

Rates are calculated based on normal use of the equipment taking into account the duration and particular conditions of use.

No compensation can be claimed if the use falls below the intended use.

If usage is less than expected due to equipment deficiencies, the Lessor will be responsible and will have 24 hours to replace the equipment. Otherwise, the corresponding amounts will be deducted for the days in which the equipment is not operating.

5. Credit and Payments

When opening a Customer account, the Customer must, upon the first rental made, leave a deposit check for an amount corresponding to the value of the equipment being rented, which will be returned upon return of the equipment or in circumstances subject to prior agreement, with the payment term being that agreed with J. F. & VASCONCELOS, LTDA.

Payment must be made within the agreed period, and in the event of default, J. F. & VASCONCELOS, LTDA. may issue a debit note for default interest at the current legal rate.

6. Billing

All equipment rentals that begin in the first fortnight of a month will be billed on the last day of the month and subsequently on each last day of subsequent months.

All equipment rentals that begin in the second half of a month will be billed on the last day of the following month and so on.

7. Insurance

The Tenant must take out all insurance deemed necessary to guarantee his/her liability for damage caused to or by the material under his/her care, particularly accidents, misuse, or any other reason for which he/she is responsible.

8. Lessor's Obligations

The Lessor undertakes to replace any defective equipment within 24 hours.

9. Tenant Obligations

The lessee undertakes to immediately inform the Lessor of any accident or operating incident.

The Lessee assumes responsibility for the supply of electrical energy and/or fuel for the operation of the Equipment.

The Tenant must handle the equipment appropriately and responsibly.

10. Property

The Lessee does not acquire any ownership link over part or all of the equipment.

11. Equipment Transportation

Unless otherwise agreed, the transportation of the equipment will be the responsibility of the Lessor, with the associated fee being that mentioned in the Lease proposal. The transportation of replaced and/or substitute material does not involve any cost to the Tenant and is the sole responsibility of the Lessor.

12. Loss or Destruction of Equipment

In the event of loss, destruction of the material or in the event of damage such that repair of the material is impossible, the Tenant will be responsible for paying the full value of the material involved.

13. Competent jurisdiction

For any issues arising from this contract, the jurisdiction of the District of Lisbon is stipulated, expressly waiving any other jurisdiction.
